Excel Homes, the Construction Teams and Our Trade Partners follow strict guidelines enforced and set by the Alberta Government under the Occupational Health and Safety (OHS) before, during and after the build of your new home.
During the building process, your home is considered a construction zone. No access is a strictly-enforced practice unless accompanied by an Excel Homes personnel during a pre-determined walkthrough of your home. If homeowners arrive to the site unannounced, they will not be provided access to the construction site.
As safety is our number one priority; only persons listed on the contract will be permitted into the home at a maximum of 2 people AND no one under the age of 18 is allowed to accompany the homeowners at pre-determined walkthroughs to ensure everyone’s safety in the construction zone.
Throughout the home building process, your Site Superintendent will inspect your new home build location to ensure all appropriate safety controls are in place and effective. Some examples of some safety controls are: access ramps and railings, guards across window openings, hand and guard rails around stairs and floor openings, fencing to prevent access to open trenches, etc.
You will also be informed of any safety dress codes for your walkthroughs. We ask that you please dress appropriately for a construction site. We will provide hard hats when required, and we ask that you wear sturdy closed-toed footwear.

A.6 PURCHASER’S LIABILITY - SITE INSPECTIONS
In consideration of the Purchaser being allowed to participate in authorized, escorted visits to the Land and Home, while under construction, the Purchaser hereby acknowledges, consents and agrees as follows: a) Site Inspections and Site Visits by the Purchaser must be scheduled in advance by the Builder. The Purchaser acknowledges that Site Inspections and Site Visits will not be scheduled during the peak Showhome hours of 12:00 – 5:00 pm on weekends and holidays and are at predetermined construction stages as determined solely by the Builder.
The Builder reserves the right to deny access to the site and to the Home for all unscheduled inspections; b) No site inspection of the Land or Home by the Purchaser is permitted unless the Purchaser is escorted by a representative of the Builder. Visits by any person who is not a Purchaser to the Home and Land will be at the sole discretion of the Builder. During any site inspections, the Purchaser must comply with any of the Builder’s health and safety regulations, including wearing any safety equipment as designated by the Builder, including hard hats, with no exceptions . c) The Purchaser has been advised by the Builder that the construction site is a work site, and a hazardous place, and that there may be unforeseen dangers that are normal for a construction site and that since there may be various trades and suppliers working on the construction site at various times (excavators, framers, roofers, etc., each with their own type of materials, tools, and equipment), which the Builder does not own, operate or control or is in a position to be aware of, or warn of all of the risks, and the Purchaser has full knowledge of the nature of these risks and that even authorized, escorted visits may result in physical harm, bodily injury, financial loss or death to the Purchaser or loss to the Purchaser's property (the "Assumed Risks"). The Purchaser hereby assumes full responsibility for the Assumed Risks however caused and even if the Assumed Risks may have been caused or contributed to by the negligence of the Indemnified Parties (as defined below) or their various trades or suppliers or have resulted from the breach of duty of care prescribed by the Occupiers' Liability Act, R.S.A. 2000 c. 0-4 (the "Act"). d) The Purchaser hereby agrees to release, discharge and agrees not to sue the Builder and any of its employees, directors, officers, agents, and independent contractors, (collectively, the “Indemnified Parties”) from any and all claims, demands, causes of action or liability of any kind whatsoever in respect of the Assumed Risks that the Purchaser may now or in the future incur which in any way result from the Purchaser’s attendance at the construction site at any time and to indemnify and save harmless the Indemnified Parties from and against all liabilities, actions, lawsuits, damages, claims, demands, financial or other loss, arising out of or in respect of the Assumed Risks. e) The Purchaser agrees that this acknowledgement, release, and indemnification will be binding on his/her heirs, executors, administrators, approved assigns and personal representatives; is given freely and of the Purchaser’s own will, and that the Purchaser acknowledges having read this section prior to signing the Agreement.
