Calgary Purchase Agreement Example:
- a) EXTERIOR COLOURS: The Purchaser will select exterior colours either during the purchase agreement appointment, by executing the Exterior Colours Selection Form attached as Schedule “V” hereto, or within four (4) calendar days of the Purchase Agreement date. In the event that the Purchaser does not select or sign off on the exterior colors by the Exterior Colours Due Date, or in the event construction of the Home is past the Exterior Colours Due Date, the Builder reserves the right to select the exterior colours on behalf of the Purchaser, and the Builder’s selection of the exterior colours shall be binding on the Purchaser.
- b) INTERIOR SELECTIONS: The Purchaser will choose interior selections no later than the removal of the “Purchaser’s Conditions” date outlined in Clause 7a. and will be signed by the Purchaser and Builder on the Schedule B or on a Change Order. In the event that the Purchaser does not make the interior selections or sign off on the interior selections by the Interior Selection Due Date, or if construction of the Home is past the Interior Selection Due Date, the Builder reserves the right to choose the interior selections on behalf of the Purchaser and proceed with the construction of the Home, and the Builder’s choice of the interior selections shall be binding on the Purchaser. No changes to the interior selections will be permitted after the Interior Selection Due Date unless agreed to in writing by the Builder.
- c) STRUCTUAL CHANGES ACKNOWLEDGEMENT: The Purchaser acknowledges and agrees that all structural changes have been selected and approved by the Purchaser, and the approved structural changes form part of this Agreement as part of the Schedule B. No further structural changes are allowed. Structural changes consist of changes that affect the overall structure of the home. Structural changes include but are not limited to the following: (i) Basement windows; (ii) Preplanned options (PPO’s); (iii) Wall heights to main floor, second floor and basement; (iv) Cantilevers or fireplaces; (v) Decks; (vi) Verandas; (vii) Driveway/sidewalk dimensions; (viii) Side entries; (ix) Walkout and daylight basements; (x) Air conditioning units; (xi) Developed basement and/or loft layouts
Edmonton Purchase Agreement Example:
- a) EXTERIOR COLOURS: The Purchaser will select exterior colours either during the purchase agreement appointment, by executing the Exterior Colours Selection Form attached as Schedule “V” hereto, or on or before the contract Purchaser Condition removal date. If the Purchase Agreement is written without conditions in favour of the Purchaser, then Exterior Colours must be completed at time of execution of the Purchase Agreement. In the event that the Purchaser does not select or sign off on the exterior colours by the Purchaser Condition removal date, if any, or in the event construction of the Home is past the Purchaser Condition date, the Builder reserves the right to select the exterior colours on behalf of the Purchaser, and the Builder’s selection of the exterior colours shall be binding on the Purchaser.
- b) INTERIOR SELECTIONS: The Purchaser will choose interior selections within seven (7) calendar days of Removal of Purchaser Conditions (the “Interior Selection Due Date”) and will be signed by the Purchaser and Builder on Schedule B or on a Change Order. In the event that the Purchaser does not make the interior selections or sign off on the interior selections by the Interior Selection Due Date, or if construction of the Home is past the Interior Selection Due Date, the Builder reserves the right to choose the interior selections on behalf of the Purchaser and proceed with the construction of the Home, and the Builder’s choice of the interior selections shall be binding on the Purchaser.
